The petition filed before Additional Sessions Judge Prashant Sharma highlights that VanDyke has allegedly been on a hunger strike since May 2026. His requested grocery list is notably specific, including shrimp, pasta, red meat, chicken, olive oil, soya milk, and bottled water. Furthermore, he has asked for permission to use kitchen appliances such as an induction cooker, pots, bowls, and a plastic chopper to maintain his health while in custody.

The context of VanDyke's incarceration is grave. He was apprehended at Kolkata airport alongside six Ukrainian nationals in a major operation by the NIA. The agency alleges that the group was involved in a high-level conspiracy to support banned insurgent groups in India by facilitating the supply of weapons and drone technology. Charged under the Unlawful Activities (Prevention) Act (UAPA), the investigation continues to probe the extent of his links to cross-border terror networks. The court has directed Tihar Jail authorities to submit a response, with the next hearing scheduled for July 21.
