In a major legal breakthrough, the Calcutta High Court has allowed the Mamata Banerjee faction to access TMC bank accounts for operational expenses under judicial supervision.

In a landmark interim order that has sent ripples through West Bengal's political landscape, the Calcutta High Court has granted the Mamata Banerjee faction the authority to conduct limited transactions from three Trinamool Congress (TMC) bank accounts. This decision provides much-needed financial breathing room to the veteran leader amidst an intense internal power struggle for the party's control.

Judicial Oversight and the Special Officer

To ensure transparency and prevent misuse, Justice Sougat Bhattacharyya's single bench has appointed retired Justice Subrata Talukdar as a Special Officer. Under this arrangement, all expenditures from the designated accounts must be authorized through checks signed by two designated party officials. The Special Officer will strictly monitor that the funds are utilized solely for the day-to-day administrative and operational requirements of the party, preventing any diversion of funds for unauthorized purposes.

Court Questions Police Action

The High Court also raised serious questions regarding the police's decision to freeze the accounts. The bench noted that the FIR was lodged on June 18, and the accounts were frozen just a day later on June 19. The court observed that the police failed to provide sufficient or convincing evidence to justify such a hasty and drastic measure. Crucially, the court emphasized that this interim relief does not constitute a legal recognition of any faction as the 'official' Trinamool Congress, as the ultimate authority on party recognition remains with the Election Commission.

This legal development comes at a critical juncture for the TMC. Following recent electoral shifts, the party has faced significant fragmentation. With nearly 20 MPs merging into the NCPI and over 60 MLAs in Kolkata breaking away under the leadership of Ritabrat Banerjee, the party's structural integrity has been under siege. By securing control over the party's financial assets, Mamata Banerjee has managed to retain a vital tool for political survival and organizational maintenance during this period of unprecedented instability.
